CHAPTER 116: CABLE TELEVISION
§116.11  CONSTRUCTION STANDARDS AND SPECIFICATIONS

(A) Within three years after the enactment of this chapter, the grantee shall have upgraded the cable system as described in this chapter. The upgraded cable system shall be designed, spaced and constructed to a 750 MHz design by a date that is no later than three years, or sooner if possible, from the effective date of the franchise granted under this chapter. The fiber system shall have a maximum of 500 subscribers to the node. Where technically advisable, the system shall use all new fiber optics, coaxial cable and electronic and passive devices. Within 30 days of the commencement of construction, grantee shall furnish to the government a map indicating the sequence of the fiber optic network construction schedule.

(B) The cable system, upon completion of the upgrade, shall have a fully activated capacity of carrying outbound from the central distribution point at least 100 channels of television to all subscribers located within the confines of the city.

(C) Where the signal of a music channel or a service provided on a per channel or per view basis originates in stereo, the grantee shall provide stereo retransmission of those signals.

(D) The grantee shall at all times comply with the latest published version of the following codes and standards to the extent that such codes and standards are consistent with local law: National Electrical Safety Code (published by National Bureau of Standards); National Electrical Code (published by National Bureau of Fire Underwriters); Standards of Good Engineering Practices for Cable Measurements on Cable Televisions Systems (published by National Cable Television Association); Standards of the Occupational Safety and Health Administration and Standards for Steel Antenna Towers and Antenna Supporting Structures (published by Engineering Department of the Electronic Industry Associations). To the extent that such codes and standards are inconsistent with other provisions of this franchise or with local law, the latter will govern.

(E) Installation and physical dimensions of any tower constructed for use in the cable television system shall comply with all appropriate Federal Aviation Agency regulations.

(F) Any antenna structure in the cable television system shall comply with Construction, Marketing and Lighting of Antenna Structure, 47 C.F.R. 17.1 et. seq., September 1967.

(G) The grantee shall at all times use ordinary care and shall install and maintain in use commonly accepted methods and devices for preventing failures and accidents which are likely to cause damage, injuries, or nuisances to the public.

(H) The grantee shall construct and operate the system and related facilities in accordance with all generally accepted related industry codes and standards that are applicable.
 
(I) The grantee shall use the most advanced engineering practices and equipment generally employed in similar circumstances to maximize off?air signal reception, to eliminate power line interference, ghost cancellation and co-channel interference. At all times, the grantee shall take prompt and diligent action to resolve problems with off-air signal reception.
