For violation of any of the provisions of this chapter, the penalties may be recoverable from the performance bond as follows:

(A) For failure to complete construction and installation of the system, complete line extensions, or provide service in accordance with this chapter and the grantee's application as incorporated herein, unless the City Council specifically approves the delay by resolution, the grantee shall forfeit $500 per day or part thereof that the violation continues.

(B) For failure to provide data and reports as requested by the government and as required in §§ 116.08 and 116.31, the grantee shall forfeit $100 or part thereof that the violation continues.

(C) For failure to comply with the operational standards following the City Council’s resolution directing the grantee to make improvements pursuant to § 116.21, the grantee shall forfeit $200 per day or part thereof that the violation continues.

(D) For failure to test, analyze, and report on the performance of the system following the request of the government pursuant to §§ 116.20, the granter shall forfeit $100 per day or part thereof that the violation continues.

(E) For failure to pay the franchise fee when due pursuant to § 116.08, the grantee shall forfeit $100 per day or part thereof that the violation continues.

(F) For failure to comply within 30 days of any City Council resolution directing compliance with any other provisions of this chapter, the grantee shall forfeit $100 per day or part thereof that the violation continues.
